Florida's Continued Assault on Race Haulers

A few months ago there was a lengthy discussion about Florida DOT requiring applicable "toterhomes" to be registered as trucks rather than RVs. While visiting the East Bay website, I noticed that Florida has a "new" (their words) requirement for haulers exceeding 65 feet to buy a permit for $20. I went on to check the Florida DOT site and they have defined the difference between an RV and a Truck. They even have pictures. A "toterhome" pulling a trailer that no part of rests on the prime mover may be considered an RV. A "toterhome" that has a fifth wheel and part of the trailer sits on the prime mover must be registered as a truck. At least thats a layman's opinion of the rule. Probably won't affect many midwest teams as all the winter racing in FL is winged but I have seen local UMP modifieds at Volusia.

Another fiine example of "big brother" sticking his nose in to extort more money from people for no reason.

Don't count on that for very much longer as big brother continues his intrusion.


PS Don't pee outside while you are down there, I just read where a guy in Key West who peed outside during one of their festivils gets to wear a ankle braclet for 25 years and register for life, for being a sex offender. Be careful Florida is a nuts place legally to go anymore.

I don't think this is limited to Florida and a Florida law only. From what I understand (and that is sketchy at best), this is federal law. So this will apply to Indiana as well. GVW up to 10,000 lbs., DOT inspection and DOT numbers on vehicle, if vehicle is 26,000 lbs. GVW, a CDL is required, drug screen, log book, all required DOT stuff. Then throw in racers are FOR HIRE and doing it as a business. If stopped, your vehicle can be impounded. I read on another site where a guy was stopped, with an open trailer and forced to leave his car, tools, everything on/in the trailer at a weigh station along the interstate, nice.

This is big brother at it's finest:moon:

You are right race fan 75. After talking to the ISP DOT lady at the Seymour, IN weight scales she informed me that if the total truck and trailer weight was over 10,001 lbs then I had to have DOT #s and vehicle inspection. She also said if I travel over 115 miles from the base of operation then I had to provide a log book. If the truck and trailer weight is over 26,001 lbs then the driver has to have a CDL. She said they go by the GVW marked on the vehicle and they don't care if you have it marked private coach, not for hire, or registered RV. If you are towing something that you make money from then you meet the criteria for the DOT rules.

I wonder what the Constitution says about this.......

oh yeah I remember

Article I Section 10
No state shall, without the consent of the Congress, lay any imposts or duties on imports or exports, except what may be absolutely necessary for executing it's inspection laws: and the net produce of all duties and imposts, laid by any state on imports or exports, shall be for the use of the treasury of the United States; and all such laws shall be subject to the revision and control of the Congress.

The Supreme Court has determined this to mean States can not make laws that effect interstate comerse. Race teams comming from out of state to spend money and make money in state sure qualify as comerse.


When can we get canidates that have actually read the Constitution?
