Again - not excusing - just saying, use some common sense.

Lets look at some facts:

1-The guys name was Archibald, he was doing a minimal job(probably part time) for minimal pay. There is a really good chance he does not know KK! The job description was to check all for credentials , suit or not!
2- Anytime you use physical force, when you are not being attacked, you are guilty. Why push anyone to the ground that is not phisically putting you in danger!

Final thoughts:
1- My bet is Archy was not a very big guy
2- The guy that is the witness, is also the guy that filled out the police report! OPPS!!
3- Archy needs to hold out for $250,000 min. Even if he pre-planned trying to agitate a rich driver. If your going to attack people physically, than be willing to pay the price!!

Ya, you're right. I'm just used to seeing the local law enforcement people volunteer to be security so they can get closer to the celebs so they can get the bragging rights of being close personal friends with someone they've never met and don't have to wait in line for the autograph and.............blah, blah, blah.

I just think they could have tried a little harder to spell his name right. Errors in police reports are the first thing a good attorney looks for.

I'm just saying .................common sense should have prevailed - on both sides. Attacks come in many forms. Apparently it was a bad day for all involved.

Kasey has his limits just like every single one of us. I bet he just pushed this guy aside (not to the gound like Urlacher) in disgust and frustration. It happens. The only reason the police report was filed was to back up the lawsuit. Kasye will right a check to keep this out of the news as much as he can. Sad to see this and the Detective is in on the take. Read his report! He writes it as if he took a online accredidation course from Yale. He knew where this report was going and spiced it up.

I have never had to call the "on Call" Atorney General for permission to arrest someone!???

Maybe the security guard mistook him for Jimmy Johnson or Jeff Gordon. In that case the shove would have been justified:checkered:

Over reactions by both sides, Quite honestly I be the security guard got smart first, WELL THEN YOU CAN'T ENTER! Instead of Could you please wait till we get someone to confirm your who you say you are??

The Charge is Batterie and again I'll state that means Kasey pushed him to the ground *THEN BEAT THE CRAP OUT OF HIM* WRONG!
Chuck, who says you could be injured from a shove but that was not the intent of the action.

Ok, so I hang arround this board EVERY day though do not post much, but I'd like to put my two cents on this one. I know some one extremely close to Kasey and the fact of the matter is the 300 plus pound security gaurd is looking for a free lunch. Kasey simply tried to walk arround him they bumped, the big guy lost his balance and fell down thus causing massive ego trauma. Kasey was then handcuffed for about ten min, the cops got statements and let him go WITH OUT cridentials as they obviously could tell by the driver suite it was really Kahne. Now I no rules are rules and they should be followed but c'mon falling on your ass does not call for a law suite, all though we do live in the good ole Sue happy US of A

I have the solution

Do not let anyone with out a HARD CARD into the pits and garages this limits it to team members, sponsers and drivers

Fans should never be in the pits to many people are trying to do their job and do not need to be bothered

At most tracks the RV lock up is right next to the garages so if it requirers proper creds to get in the garages then there is not a need for a guard at the RV gate

Lets face here are Kasey's creds most likely on the floor of his RV where he changed into his drivers suit

The same place every other drivers creds were

He is not going to have his creds on him when he is in the car and in today's everything ends up on e-bay lifestyle it would not be safe for him to leave them anywhere else

Go to a sprint car track and see how often they ask to see the arm band of a driver in uniform or if the track does not have arm bands check to see how many drivers walking though a secured gate have the pass on them when they have their suit on

Sean you know thats not gonna happen, Theres too much money to be made. sad but true. It's also a requirement by many sponsors to allow SPECIAL GUEST into the backlot at these events.
