That being said. Smoke walks into a franchise he never earned..

I'm sure that the contract says the franchise stays with Rico along with the money associated with it.

It's Rico's Franchise. Tony just leased it from him as part of the deal. They both were a willing participant. Rico will run the entire Sprint Car operation for TSR.
