Court in UK agrees with race track rights!

I have been reading in another thread about people moving into houses near a race track and trying to get them closed down, we have the same problem in England.
Today a judge ruled against a family who moved to within 800 yards of a race track and tried to get it closed. He said the track was there first and had all correct permits, so he dismissed their action. I hope tracks in the USA have the same outcome if they are under threat from people who move into an area where a race track has been established for many years. The best is that with the UK's "loser pays" court system, they will have to pay all court costs.

Its called "coming to the nuisance", which generally bars such a claim unless the nuisance is such that is causing health problems, which is probably not the case with a racetrack that only is a bother once a week.
