D.O.T and Toterhomes

Just a heads up I was getting level 2 inspection at the scale house and here comes 2 toterhomes getting pulled around back. From the bits and pieces I overherd they were getting several tickets to include operating a commercial vehicle with no CDL, no medical card,no usdot number,no log book,Then they empounded and towed to a secure lot. I asked the one guy who was driving one of the trucks what happened and he said he was told since he was hauling a race car that was paid a purse for racing he was operating a business and was in violation of the way his vehicle was regestered. He was then told if he could provide proof by last years taxes that he was not operating a business. Meaning he didnt claime any income or take any wright offs from the racing the judge would dismiss the fines.Talk about a bad day.

What ever happened to innocent till PROVEN guilty. It should be up to who ever impounded the vehicles to PROVE they were operating a business. A toterhome is a motorhome if it has certain amenities inside. Tell those people Hitlers dead, & to raise funds some other way. My friend had a problem w/ his drag car in Ohio w/ the same ordeal. He called his lawyer right there on the spot. The police ended up letting him go.

Sounds like a repeat of the deal in northwest Florida a few years ago with guys towing to a show a Southern Raceway.

I think you're going to see a lot of states go this direction. It's probably a good idea for toterhome drivers to have a CDL considering the size of the vehicle and weight they're hauling.

This exact thing happened to use pulling thru New Mexico last year with a DUALLY and gooseneck trailer!

It's all about the $$$. Shakedown. It seems to be more about the drag racers (FL,CA) and the US Nats were this weekend too. My dad has a class B cdl to deliver moterhomes to 80 year old snowbirds who drive them on a regular operators license. You have a HUGE investment in toter/trailer/contents. I would rather you be behind me than that motorhome any day!

All of this is very true due to the new laws that took effect july 1. I know this to be fact because i'm a DOT inspector. And currently hold my class a. Anything that has air brakes on them as most toters do you are required to have class a. Also pickup trucks pulling trailers need a dot number on it. Federal law states if you bring money in you need to have a dot number. If its only 1 cent federal sees it as profit. Was this rule publiced? If not, I bet they did it to make money (not telling anyone that wasn't looking for the new rules).

There is a SLEW of new laws on transportation coming through in the now to near future. To say they are 'publicized' includes one's being in the way when the news comes out.
