Says they are racing next Saturday.


Attention Fans and Drivers!!!! We are RRRRRRAAACCCING NEXT SATURDAY MAY 9TH!!!! You heard that right! Ready to hear the roar of the engines? We are too! Full race show including Pro Late Models, Modifieds, Street Stock, and Sport Compact.

We feel the order of the Governor is 100% unconstitutional and a court just upheld this order as of Friday May 1. So we are READY to fight for our constitutional rights. Racetracks were specifically excluded from the government assistance which is what is being utilized as unconstitutional grounds.

Grandstands will be open but will will limit the number of fans to ensure social distancing requirements are met.

Pits open at 3pm. Grandstands open at 4pm. Racing begins at 7pm.

Drivers, we will setup a pre-registration online this week as we will require all drivers to be registered online before Saturday. So there will be no drivers allowed to register at the gate. We will have our web developer setup this site Monday.

Please please share this post as we Fight for our right to race!!

After reading the comments on their Facebook page this will be interesting to see how this all turns out. I may not care for Daugherty because of his attitude but I do hope this works out. Very likely I will be one of those trying to possibly grab tickets tomorrow. This is b.s. if folks would be smart enough to just mind their distance around others this whole social distancing might not have been as strict as it is. I personally think they should let folks take their own precautions on distancing and staying a certain amount of feet away from other people. Hopefully they don't get shut down but I think of the county learns about this planned event they will shut if down and I'm sure Michael will have something to say about it if they county decides to try an pull the plug on the event.

Just my thoughts on this.

Just an FYI to anyone questioning the law, there have been no LAWS passed regarding this virus. Laws are passed by congress, not governors. We will fight all the way to the Supreme Court for our constitutional rights! If you don't feel safe, stay home, easy as that. No one is making you come to the races. So as my friend Randy Lines says, RACE ON!

I wish them well. If that track still has all the stands it had back in 2009 there should be no problem for anybody having enough room.

I agree they should be allowed to open, Nobody forcing anyone thru the gates

Not to really be political but no order or law can or should violate the Bill of Rights. Which basically states that you are Sovereign to make your own decisions for yourself.

Cease and Desist order sent to Daugherty Speedway

The Indiana State Department of Health issued a cease and desist order on Friday to Michael Daugherty and Daugherty Speedway, Inc. concerning their plans to hold a dirt track race on Saturday, May 9 in Benton County. Daugherty said Friday that he would have to get this order to his legal counsel before making a decision to continue with Saturday's race.
The order states they should immediately stop doing business at Daugherty Speedway, Inc., located at 1160 W. 650 S., Boswell, Benton County and that his compliance will be verified. The order also says "that failure to do so will result in additional action which may include: an order to close your business; referral to the secretary of state and to any relevant licensing, permitting or certifying board, commission or other entity for consideration of revocation proceedings; and, referral to the county prosecuting attorney."
Earlier in the week, Daugherty received a letter from the Governor's office which says his business is not in this phase of the state's "Back on Track" reopening plan during the current COVID-19 pandemic, but at that time the race track owner said dirt track racing was still on for Saturday, May 9 in Benton County. "As a small business owner I feel it is my legal right to run my business," said Daugherty. "I have to be able to work, pay my bills, pay my taxes. Myself and my employees still have to be able to put food on the table for our families."
Daugherty has been posting on the Speedway's social media all week that the race is going to happen. The letter from the Governor's Office on Thursday signed by General Counsel Joseph R. Heerens says the current executive order does not include a provision for auto racing or karting tracks to begin operations now, and that auto racing and kart tracks are part of the sports venues and entertainment category and are not projected to open until a later phase of the governor's plan. "We are trying to do everything as safely as possible, and we feel we are safer than the Walmarts and big box stores," said Daugherty.
On a conference call with the chief legal counsel and the state police superintendent, Daugherty presented them his plan for Saturday's race. Daugherty said he's tried to contact local officials including the sheriff and one of the Commissioners of Benton County but received no response.
Daugherty said they are planning social distancing at the Speedway and that all staff is going to have their temperature taken before the track opens and they will be wearing masks. He also said that Saturday everyone will be required to social distance who aren't co-habituating. "So obviously if a family comes they can sit together, but everyone else has to be six feet apart," said Daugherty. He said contact-less tickets were sold online and the drivers' meeting was going to take place over radio so everyone wouldn't congregate.
"We cancelled one of our biggest money makers which was the concession stand, so we didn't have people congregating around and standing closely together," said Daugherty. He said they are also not allowing anyone in the pits to go into the stands and that only one driver and one crew person will be allowed in the staging lane.
Daugherty said pushing this issue has been a good move for racing, because before he addressed it, the state was saying tracks couldn't even be open at all until July 4 according to the executive order by Governor Eric Holcomb. Now according to the response they received, beginning May 11, closed testing and practice sessions are allowed as long as they follow the gathering guidelines of no more than 25 people, follow social distancing practice, and those 65 and older or with high-risk medical conditions aren't on site. "So it was a good concession on the governor to at least let dirt tracks make a little bit of money by issuing practice by less than 25 people," said Daugherty. "But I don't think it's gone far enough."
Daugherty did say he was extremely appreciative of the governor for extending that offer to at least let them make a little bit of revenue and that their voice is being heard now.
"By no means are we wanting to put anyone in jeopardy or in harm's way, so we completely respect everyone's opinion, even those who disagree and say we should just stay home and follow the governor's executive order," said Daugherty. "Our goal is not publicity, this is not a publicity stunt, we are just wanting to stand up for our rights and make a living and put food on the table for our families." Daugherty said the government specifically excluded race tracks from any kind of support or funding or payroll help, which puts them in a very hard place. "So with no support or anyway to make any revenue or operate they are literally bankrupting every small business that can't operate," said Daugherty.

I am with you on this. Whether or not you agree with the local regulations is one topic. However, to blatantly tell the authorities that you are going to go against there wishes and and they cannot stop you is just silly. Especially when the topic at hand is public safety.

The guy seems like a clown To me. He has taken it way to far. I originally liked what he was trying to do but but enough is enough. He is making racing look bad there’s a fine line between fighting for what you think is right, and flat out defying law and being ridiculous. Good luck to all they people he owes refunds to.

I'm SO glad you asked sir. The answer is very little but one thing is that all three states are part of the greatest experiment in history known as THE UNITED STATES OF AMERICA aka THE GREATEST COUNTRY IN THE WORLD. Pretty sure we all agree on this.

But there are some differences. California, Illinois and the state I live in (oregon) all have 4th amendment rights unlike indiana which has NO 4th Amendment rights (hello!!???)

#3 Ya know that county payroll tax they take out of your check every payday?? Not here. The last year I worked out there it amounted to one full paycheck out of my life. Now if you're "Lucky" enough to live in So. Indiana and work in Ky or vice versa then you get TWO county payroll taxes taken out AND get to pay $8 per day going across the bridge. :15:

#4 Somehow , unlike Indiana our roads are not full of potholes. That's 'cause someone pulled the road funds into a different fund and THEN added a .10c TAX on gas and a .30c TAX on Diesel. (there's that "T' word again lol.)Those are the worst roads I have EVER driven on!!! Wonder what happened to that guy?? I heard (herd?) he moved.

Seniors are well taken care of out here. I am on a VERY fixed income and I'm very grateful to Oregon for the help they give. I live in a house that now has multiple bedrooms but it was a 2 bedroom when it sold for 123k two years ago. That's a little more than Indiana I guess but out here a Min. wage person might have a chance to be a property owner.

Restaurant food is more I'm sure because something close to a living wage is being paid. Fuel is 2.08. Should be less but not Oregon's fault. Greedy oil company's who know there is more money out here.

California of course is taxed to the hilt and sadly for me is not affordable.

Of course the RACING'S better out there. IMHO it's not worth watching out here. It used to be really good in Ca. when San Jose , Capital, Ascot and the like were running but that's long gone. If ya like wings Ocean Speedway's good and USAC Midgets are good but I have not seen anything that compares to Indiana RACING on a nightly basis.

ISF, what does your sister dispute?? 4th amendment rights?? $12 min wage?? No Sales tax?? County Payroll Tax?? You can look all that stuff up. There's no utopia but just looking for another point of view as you didn't expand on your post. Hope ya have a great day!!

A bit off topic but in MY opinion timely and educational. If you have Netflix go to a series they have called "Explained", go to Season 2 and look for the episode entitled "The Next Pandemic". Note it's date Nov. 7,2019.Food for thought.

She graduated college Summa C um Laude and was born, raised and educated in Illinois. She's resided in Maryland, Panama Canal Zone prior to it being given away, Wyoming, Wisconsin, Colorado and now lives in southern Oregon to be near daughters and grandchildren but admittedly, never Indiana. That said she maintains that Oregon has the highest overall cost of living of anywhere she's lived. And again, no disrespect intended but I'll take her word over yours all day long.

Here's the Fox news story from 2011 Re: the 4th amendment. Don't think its been repealed and the really bad news is that if it gets to SCOTUS they are now stacked the same way. It saddens me that so few In. residence's are aware of this.

I was wrong on the Minimum wage out here. It is $11.25 and will be $12.00 on 7/1/20. ($13.25 in Portland metro area)

Property Tax is 1.04 and again no sales tax........HOWEVER, payroll tax starts at 5% and goes to 9.9%...........OUCH!!

So I get where your Sister is coming from. I'm guessing that if she's still working her tax rate is likely closer to 9.9 than 5%. That doesn't count Federal either. If she goes out to restaurants she will pay more than anywhere she's ever lived. I have no idea about Starbucks and the like 'cause I can't afford it.

I'm on the opposite end of the spectrum. SSI pays me a little over $800/month. I have an Oregon food card and use the pantry's. I stay home a lot 'cause when I'm home I'm not spending money. BTW, I had a business that failed around 2007 along with many others. I was owed a lot of money and that guy declared bankruptcy. In less than a year my net worth dropped by $280,000. Hard to recover from that.
